Terms of Use

These Terms of Use govern your use of SM Health, an iOS application. By downloading or using SM Health, you agree to these Terms. If you do not agree, do not use the app.
1. License
We grant you a personal, non-exclusive, non-transferable, limited license to install and use SM Health on Apple devices that you own or control, solely for your personal, non-commercial purposes.
This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise exploit SM Health or any of its content.
2. Free and Pro Features
SM Health is free to download and includes core activity-viewing features. Additional features — including advanced analytics, GPS route detail, heart rate zone analysis, and detailed per-activity metrics — are available through SM Health Pro.
3. In-App Purchases
SM Health Pro is available as a one-time in-app purchase (currently $9.90 in the App Store). There are no subscriptions and no recurring charges. Once purchased, SM Health Pro is yours permanently, including any future updates to Pro features.
All purchases are processed by Apple through the App Store. Apple's App Store Terms and Conditions apply to all transactions. Payment is charged to your Apple ID account at the confirmation of purchase.
For refund requests, contact Apple at reportaproblem.apple.com. SM Health has no control over Apple's refund decisions.
4. Restoring Purchases
If you reinstall SM Health or set up a new device, you can restore your SM Health Pro purchase at no additional charge using the Restore Purchases option within the app, provided you are signed in to the same Apple ID used for the original purchase.
5. Health Data
SM Health reads workout data from Apple HealthKit on your device. This data never leaves your device — SM Health has no servers and makes no network requests.
SM Health is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition. Do not rely on SM Health for medical decisions. Always consult a qualified healthcare professional.
We do not use HealthKit data for advertising, data mining, or any purpose other than displaying your training history within the app.
6. Privacy
Your use of SM Health is also governed by our Privacy Policy, which is incorporated into these Terms by reference. SM Health does not collect, store, or transmit personal data to any external server.
7. Intellectual Property
SM Health and all associated content, features, and functionality are the exclusive property of SM Health and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the app, nor may you reverse engineer or attempt to extract the source code of the app.
8. Disclaimer of Warranties
SM Health is provided "as is" and "as available," without warranty of any kind. We do not warrant that the app will be error-free, uninterrupted, or that defects will be corrected. We make no warranties regarding the accuracy or completeness of any data displayed.
9. Limitation of Liability
To the maximum extent permitted by applicable law, SM Health and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of or inability to use the app.
10. Changes to These Terms
We may revise these Terms at any time. When we do, we will update the effective date above. Your continued use of SM Health after any changes constitutes your acceptance of the updated Terms.
